Ch 6 Outline
1. APPLICABILITY
This policy applies exclusively to the Transformational Wrap-Around Housing Program. Additionally, the general requirements outlined in Chapter 2 are applicable to this program, except where specified otherwise in this Chapter. In cases of conflict between this Chapter and Chapter 2, the provisions of this Chapter shall take precedence for the Transformational Wrap-Around Housing Program.
2. DESCRIPTION OF PROGRAM
The Transformational Wrap-Around Housing Program is designed to assist enrolled members of the Lummi Nation and their families who require multiple wraparound services to become productive members of the community. These services may include, but are not limited to:
- Mental health support
- Chemical dependency treatment
- Family counseling
- Parenting services
- Special medical needs
It is important to note that this program is not intended solely or primarily as a housing program. Applicants whose sole need is safe and stable housing will be referred to an appropriate LNHA housing program.
Per LIBC Resolution #2014-142, the Lummi Indian Business Council has directed the General Manager to ensure the participation and coordination of meetings, activities, and work products among essential tribal agencies and departments. These essential entities include, but are not limited to:
- Lummi Nation Housing Authority (LNHA)
- Employment Training
- Lummi Counseling Services
- Lummi Behavioral Health
- Lummi Victims of Crime
- Lummi Tribal Court
- Lummi Veterans Program
- Lummi Children’s Services
The collaboration of these agencies and departments is crucial to the success of the Transformational Wrap-Around Housing Program, ensuring that participants receive the comprehensive support they need.
3. CRITERIA FOR ASSISTANCE
In addition to the general eligibility requirements specified in Chapter 2, applicants for the Transformational Wrap-Around Housing Program must meet the following additional requirements. Violation of any of these requirements may result in immediate termination from the program.
A. Criteria
1) Lummi Nation Membership
At least one adult head of household member and one child must be an enrolled member of the Lummi Nation.
2) Sponsorship by LIBC Program or Department
The family or individual must be sponsored by an LIBC program or department for enrollment in the Transformational Wrap-Around Housing Program. Eligible sponsoring programs or departments include, but may not be limited to, the following:
- Lummi Nation Housing Authority
- Employment Training
- Lummi Counseling Services
- Lummi Behavioral Health
- Lummi Tribal Health Clinic
- Lummi Victims of Crime
- Lummi Tribal Court
- Lummi Veterans Program
- Lummi Probation Department
- Lummi Home Care Agency
- Lummi Children’s Services Applicants cannot self-refer to this program.
3) History of At-Risk Behaviors
At least one member of the household must have a history of behaviors that place the individual or family at risk of future non-success without intervention from this program. Examples include:
- Jail or juvenile adjudications
- Mental health issues
- Arrests or drug/alcohol usage
- Domestic violence incidents
- Theft
- Children in dependency cases
4) Need for Supportive Environment
At least one household member must benefit from a strong, nurturing, drug, and alcohol-free community with embedded core services.
5) Screening for Honesty and Accountability
Applicants must be screened for honesty and accountability, demonstrated by their willingness to identify, and address real and potential problems in their lives.
6) Compliance with Entry Guidelines
Applicants must comply with entry guidelines developed by the Wrap-Around Team. Failure to comply may result in termination from the program.
7) Recognition and Willingness to Address Problems
Applicants must be willing to recognize problems and take steps to correct them. Indicators of strong defense mechanisms, such as rigidity of thought, must be addressed through appropriate settings (e.g., inpatient, intensive outpatient programs, domestic violence treatment, parenting classes, or mental health services) prior to program enrollment.
8) Background Check
All household members over the age of 18 must pass a background check, including:
- No outstanding warrants in any jurisdiction
- No felony convictions for violent crimes in any jurisdiction
- No history of felony sex offenses in any jurisdiction
9) Release of Information
Applicants must be willing to sign Release of Information Forms to allow service providers to collaborate.
10) No Pets Allowed
No pets of any kind are allowed in Transformational Wrap-Around Housing Program units.
11) Urinalysis Requirement
All household members must pass a urinalysis (UA) before admission. Failure to pass by any household member aged 14 or older will delay the application by 60 days. During this period, the individual must enter a chemical dependency program to address addictive behaviors before eligibility to reapply.
12) Mental Health Assessment
All applicants and household members must complete an assessment with a designated mental health professional to determine the program framework. Recommendations from other service providers will be integrated into this individualized plan.
13) Meeting with Service Providers
Applicants must meet with various service providers to review their individualized plan. If the applicant chooses not to adopt the plan or an agreed modified plan, they will be referred to the Rental Housing Program or another appropriate LNHA housing program.
14) Household Composition
Household members are limited to immediate family members as determined at the time of application.
15) Single Adult Housing
Single adult applicants cannot be placed in a pod with households containing children. If no pod unit is available for single applicants, their applications will be held until a suitable unit becomes available.
16) No Overnight Guests
No overnight guests are allowed in Transformational Wrap-Around Housing Program units.
4. TRANSFORMATIONAL WRAP-AROUND PROGRAM PRIORITIES
The Transformational Wrap-Around Housing Program, subject to the eligibility requirements listed above, shall be open to all low-income Lummi tribal members. This includes both individual applicants and family units who meet the specified criteria. Priority will be given to those demonstrating the most urgent need for the comprehensive support services provided by this program.
5. SELECTION PROCEDURE AND REQUIREMENTS
After applicants are selected and deemed suitable for the Transformational Wrap-Around Housing Program, they will receive a notice of suitability, which may be delivered in person, verbally, or in writing.
By following these procedures, LNHA ensures that applicants are formally committed to participating in the Transformational Wrap-Around Housing Program and are prepared to engage fully with the support services offered.
The following steps and requirements must be adhered to:
A. Written Commitment
Within seven (7) days of receiving the notice of suitability, the applicants must supply LNHA with a written commitment from the Transformational Wrap-Around Program Manager that confirms their participation in the program.
B. Failure to Submit Commitment
Failure to provide this written commitment within the specified seven (7) day period will result in the withdrawal of the applicant’s application and denial of entry into the program.
6. INCOME REQUIREMENTS
A. Income Limits
- Participation in the Transformational Wrap-Around Program requires a household income at or below 80% of the applicable median income. See Appendix A, Page 155.
- Income eligibility shall be determined at the time of application and during the determination of suitability.
7. EXECUTION OF AGREEMENT OF PARTICIPATION
Prior to occupancy of a unit, every participant shall execute a Participation Agreement. The executed Participation Agreement shall supplement these Policies and Procedures in describing the rights and responsibilities of the parties. The participant shall receive a signed copy of the Participation Agreement.
8. TERMINATION OF PARTICIPATION AGREEMENT
A. Termination by Participant
A participant may terminate his or her Participation Agreement by providing LNHA with ten (10) days written notice.
B. Termination by LNHA
LNHA may terminate a participant’s Participation Agreement for non-compliance with either the Agreement/Contract or these Policies and Procedures. This termination process will be carried out with the following legal and procedural details:
1) Written Termination Notice
- Notice Requirements
Participants will receive a written Termination Notice delivered either in person, via certified mail, or through any other verifiable method. - Details of Violation
The notice will clearly outline the specific program rule or Agreement/Contract violation(s) that led to the termination decision. It will also specify the date by which the participant must vacate the premises, allowing a minimum of 7 days from the date of notice for compliance.
2) Non-Compliance Consequences
- Police Assistance
If the participant fails to comply with the Termination Notice or refuses to vacate the premises by the specified date, Program staff will contact local law enforcement to ensure the participant is removed from the premises. - Legal Action
LNHA may initiate legal proceedings, including but not limited to eviction proceedings, to enforce the Termination Notice. All associated legal costs incurred by LNHA in enforcing the termination may be borne by the participant as stipulated in the Participation Agreement.
3) Immediate Termination
- Risk of Imminent Harm
In cases where the Program staff assesses that the participant’s continued presence presents a risk of imminent harm to LNHA staff, to themselves, or to other LNHA participants or residents, LNHA reserves the right to terminate the Participation Agreement without prior notice. - Emergency Procedures
Immediate termination will include notifying local law enforcement and potentially emergency services to address any immediate safety concerns.
4) Prohibition from LNHA Property
- Enforcement of Prohibition
Following termination, the participant will be prohibited from accessing any LNHA property for any reason. Violation of this prohibition may result in trespassing charges being filed against the participant. - Notification
The Termination Notice will include a clear statement regarding the prohibition from LNHA property and the potential legal consequences of violating this order.
9. VIOLATIONS OF THE AGREEMENT OR TRANSFORMATIONAL WRAP-AROUND PROGRAM
In the event that participant(s) violate their Participation Agreement or these policies, LNHA may implement the following corrective measures.
Each case will be evaluated individually, and termination decisions will be made based on the severity and impact of the violation.
The following measures and requirements must be adhered to:
A. Development of a Corrective Plan
1) Collaboration Requirement
Participants may be required to work with LNHA staff to develop a corrective plan aimed at preventing future violations. This plan will outline specific actions and responsibilities to ensure compliance.
2) Plan Implementation
Participants must adhere strictly to the terms of the developed plan. This includes attending scheduled meetings, completing agreed-upon tasks, and making necessary behavioral changes.
B. Failure to Comply
1) Non-Cooperation
Failure to work with LNHA staff to develop and implement a corrective plan may result in termination from the program.
2) Violation of Plan Terms
Failure to adhere to the terms of the corrective plan may also be grounds for termination of the Participation Agreement.
C. Serious Violations
1) Immediate Termination
In cases of serious violations, LNHA reserves the right to terminate a Participation Agreement or Contract immediately, without offering an opportunity to develop a corrective plan with LNHA staff.
2) Criteria for Serious Violations
A serious violation includes, but is not limited to, actions that pose a significant risk to the safety and well-being of LNHA staff, participants, residents, or property.
10. RULES OF OCCUPANCY
Violation of any of the following rules by Transformational Wrap-Around Program participants, household members, or guests may be grounds for termination from the program. LNHA may terminate the participation of all household members depending on the circumstances surrounding the violation. LNHA Security is responsible for enforcing these rules and has the authority to issue citations for violations. Additionally, at the sole discretion of the LNHA Executive Director, participants and/or associated household members who have violated these rules may be allowed to continue residing in the Transformational Wrap-Around Program. The LNHA Executive Director shall convene a special Wrap-Around case consultation meeting to discuss the circumstances with the team.
A. Illegal Drugs
1) Prohibition
Illegal drugs shall not be used by Program participants, household members, or guests, nor shall they be allowed in Transformational Wrap-Around Program units.
2) Testing and Evidence
If illegal drugs are found in a Program unit, or if a participant tests positive for drugs in a test administered or recognized by LNHA, the participation of all household members may be terminated. If evidence of Methamphetamine or its use is found in an LNHA unit, or if any household member tests positive for Methamphetamine in a recognized test, the participation of all household members shall be terminated immediately.
3) Appeal Process
Such termination may only be appealed to the Executive Director, whose decision shall be final.
The LNHA Board of Commissioners has determined that residential structures containing any of the following substances in excess of specified limits are unsafe for human habitation, particularly for young children:
- Methamphetamine: more than 1.5 micrograms per 100 square centimeters.
- Total lead: more than 20 micrograms per square foot.
- Mercury: more than 50 nanograms per cubic meter of air.
- Volatile organic compounds (VOCs): more than 1 part per million total hydrocarbons and VOCs in air.
If any housing unit owned and operated by LNHA exceeds these contamination thresholds, LNHA personnel shall:
4) Immediate Action
Notify and remove occupants immediately.
5) Notification
Contact LNPD as soon as practicable and notify the Lummi Public Health Officer, requesting that the housing unit be quarantined.
6) Quarantine and Decontamination
The housing unit shall remain quarantined and closed to habitation until decontamination by a licensed contractor is completed.
Refer to the Methamphetamine Remediation Policy in Chapter 3, Section 21, Page 77 for more details.
B. Prohibition of Subleasing
1) Boarders and Subleasing
Participants shall not take in boarders, sublease, or assign the unit to anyone else.
2) Overnight Guests
No overnight guests are permitted at any time.
C. Damage to the Unit
Participants, household members, and guests are prohibited from damaging, defacing, vandalizing, or destroying any part of the unit.
Participants are encouraged to report any damage immediately and take necessary precautions to prevent further damage.
The following guidelines will apply:
1) Responsibility for Actions
All participants are responsible for the actions of all household members and guests regarding the condition and maintenance of the unit.
2) Extent of Damage
If a unit requires more than $1,000 in non-routine maintenance due to damage caused by participants, household members, or guests, LNHA may terminate the participant’s involvement in the Transformational Wrap-Around Program.
Repeated instances of damage that are the responsibility of the participant may also be grounds for termination from the Program.
D. Criminal Charges
Participant(s) and/or all members of the household may be terminated from the Transformational Wrap-Around Housing Program.
Termination decisions will be based on the nature and severity of the charges and the potential impact on the safety and well-being of other program participants and household members. All cases will be reviewed individually to ensure fair and appropriate action.
The following offenses include, but are not limited to:
1) Violent or Sex-Related Crimes
Any violent crime or crime of a sexual nature.
2) Burglary or Robbery
Any degree of burglary or robbery.
3) Theft-Related Offenses
Theft involving the use of a firearm, or theft in any degree.
4) Drug-Related Offenses
Any drug offense, including but not limited to, possession, possession of paraphernalia, and/or furnishing alcohol to a minor.
5) Domestic Violence and Child Abuse/Neglect
Charges related to domestic violence and/or child abuse and neglect.
E. Addition of New Household Members
1) Prohibition of Additions
After initial occupancy, no new individuals may be added to the household.
2) Assessment of Initial Household Members
At the discretion of the LNHA Executive Director, an individual who was initially included as part of the household composition may be deemed unsuitable based on a positive drug test or criminal charges and may be prohibited from being on LNHA property.
If this individual is cited for violating this provision more than once, they will be officially trespassed, and the Head of Household (HOH) may be found in violation of LNHA Policies and Procedures.
F. Failure to Timely Report Changes in Income or Household Composition
All changes in income and/or household composition must be reported through an Interim Recertification within fourteen (14) days of occurrence. If LNHA determines that a participant has failed to timely report these changes, LNHA will retroactively assess the participant for all increases in rent that would have been due under the new household composition.
G. Use of the Unit as a Business
Participants, household members, or guests are strictly prohibited from using the unit for the operation of any business.
H. Modifications to the Unit
Participants shall not make any structural modifications or permanent alterations to the unit without obtaining prior written approval from the LNHA. Additionally, any modifications to existing locks or the installation of additional locks must be carried out exclusively by LNHA.
I. Violation of Right to Quiet Enjoyment and Other Legally Prohibited Acts
Participants, household members, and guests who engage in unlawful or other activities which interfere with their neighbors’ right to quiet enjoyment of their premises may be terminated. These activities include, but are not limited to, repeated visits by law enforcement, lack of supervision of children, violation of curfew laws, loud parties, and loud arguments.
J. Pets
No pets of any kind, including fish, are allowed in Transformational Wrap-Around Program units.
K. Failure to Maintain Utilities
Participants are required to maintain continuous heat, electric, and water services to their units at all times. Should any of these utility services be terminated or “locked off,” the participant may face termination from their respective LNHA Program.
1) Responsibility for Damages Due to Utility Disconnection
In the event that utility services are disconnected due to the participant’s negligence or failure to pay, any resultant damages—such as a burst water line due to inadequate heating—will be the full responsibility of the participant. The costs associated with repairs and damages will be assessed and added to the participant’s account receivables. These charges will be payable immediately, unless a prior payment arrangement has been expressly approved by the Executive Director.
L. Automobiles
1) Vehicle Definition
For the purposes of this policy, “Vehicle” is defined in accordance with the Lummi Nation Code of Laws, Title 7, Motor Vehicle Impoundment Code, Section 7.01.010(c). This definition includes any car, truck, motorcycle, other wheeled machine, or boat that was designed to be, or at one time was, self-propelled or towed, or in the case of boats, propelled by mechanical, natural, or human force, and capable of being operated over land, a roadway, or water.
2) Vehicle Registration Requirement
Participants are required to register all vehicles with the LNHA Security Office. Each household is permitted a maximum of three (3) vehicle registrations unless special authorization is provided in writing by the Executive Director. The following procedure will be enacted if an unregistered vehicle is repeatedly observed on a tenant’s premises:
- First Offense
A written notice will be affixed to the unregistered vehicle, mandating the removal of the vehicle within three (3) days. - Second Offense
A formal citation will be issued by the LNHA. - Third Offense
The unregistered vehicle will be impounded at the tenant’s expense. All costs incurred by the LNHA for the removal of the vehicle, including but not limited to towing fees, will be billed to the participant.
3) Vehicle Condition Requirement
All vehicles located on the participant’s property must be legally licensed, with current registration, and in a safe, operable condition. Vehicles that do not meet these criteria will be subject to removal.
4) Parking Restrictions
- Parking on grass or yard areas is strictly forbidden.
- Parking in designated restricted areas will result in the issuance of a citation by LNHA Security.
- On-street parking is permitted only where there is yellow or green paint on the curb or street to denote allowable parking zones.
- Failure to move a cited vehicle within twelve (12) hours will result in the vehicle being towed, with all associated towing and impound fees charged to the participant’s account.
5) Removal of Abandoned Vehicles
- Automobiles that are without license plates, with expired tags, or that have been in a non-running condition for more than ten (10) days will be deemed abandoned.
- Upon identifying an abandoned vehicle, the LNHA will issue a written Notice to Remove to the participant, requiring removal within two (2) days of the notice date.
- If the vehicle is not removed within the specified timeframe, the LNHA will proceed with disposal of the vehicle in accordance with this Policy and Titles 7 and 14 of the Lummi Code of Laws, which are hereby incorporated by reference and made a part of this Policy.
- All costs incurred by the LNHA for the towing and impoundment of the vehicle will be charged to the participant’s account receivables.
- Non-payment of these charges constitutes grounds for termination or non-renewal of the participant’s lease agreement.
M. Sex Offender Visitation
In an effort to protect the well-being of children and vulnerable adults residing in Transformational Wrap-Around Program units, LNHA strictly prohibits participants and household members from permitting sex offenders or individuals convicted of sex crimes onto their rental unit premises. Compliance with this policy is mandatory to ensure the safety of the community.
LNHA reserves the right to take immediate and appropriate actions, up to and including termination of tenancy, to uphold the safety standards and regulations of the housing program.
If a sex offender or individual convicted of a sex crime is seen on the premises of the participant’s rental unit, the following actions will be taken:
1) First Incident
A citation will be issued to the participant, documenting the violation.
2) Subsequent Incidents
Upon the occurrence of a second or subsequent incident, additional citations will be issued. Two or more citations may result in the termination of the participant’s lease agreement.
N. Health and Safety Guidelines
1) House Guidelines
- All walls, floors, doors, appliances, sinks, toilets, and showers must be kept clean and free of dirt, grime, mold, stickers, and other marks.
- Rental tenants are prohibited from painting or drawing on walls or doors.
- Clear pathways of at least 3 feet wide must be maintained to all doors and windows to ensure safe and unobstructed access.
- Trash and recyclables must be properly disposed of in designated receptacles.
- All clothing should be properly stored in closets, dressers, hampers, or neatly piled near the laundry area.
2) Yard Guidelines
- Participants are responsible for the maintenance of their yard area. The LNHA does not provide yard care services.
- Yards must be kept in a clean and sanitary condition at all times. Trash and recycling should be properly disposed of in designated receptacles, and grass must be cut to prevent overgrowth.
- Participants wishing to install wading/swimming pools or trampolines on LNHA Transformational Wrap-Around Program units must file written waivers of liability, using forms specified by the LNHA, prior to installation.
- Travel trailers and recreational vehicles of any kind are strictly prohibited on LNHA Transformational Wrap-Around Program units due to liability concerns.
- Open fires, burn barrels, and fireworks are strictly prohibited on LNHA Transformational Wrap-Around Program units due to liability concerns.
- All fishing bait and animal carcasses must be properly stored and/or disposed of to maintain sanitary conditions.
3) Failure to Maintain Yard
Participants are required to keep their yard in a clean and sanitary condition as outlined above. Failure to comply shall be managed as follows:
- First Offense
A warning notice will be issued, granting the participant one (1) week to bring the yard into compliance. - Second Offense
A second warning notice will be issued, addressing non-compliance with the first notice, and providing the participant with 48 hours to bring the yard into compliance. - Third (Final) Offense
A final warning notice will be issued to notify the participant that termination or non-renewal of their lease agreement may be pending due to failure to address the first and second warnings. A final 48-hour period will be provided to bring the yard into compliance.
11. SPECIAL PROVISIONS FOR NON-INDIANS PARTICIPATING IN THE PROGRAM BY VIRTUE OF THEIR CUSTODY OVER A MINOR CHILD WHO IS AN ENROLLED MEMBER OF THE LUMMI NATION
Non-Indian participants who are residing in a Transformational Wrap-Around Program units due to their custody of a minor child who is an enrolled member of the Lummi Nation must maintain permanent physical custody of the enrolled child to continue participation in the Transformational Wrap-Around Program.
These provisions are enacted to uphold the integrity of the Transformational Wrap-Around Program and ensure that resources are allocated fairly and appropriately to enrolled members of the Lummi Nation.
Specific provisions are as follows:
A. Custody Changes
If at any time the non-Indian custodian loses permanent physical custody of the enrolled child, their eligibility for the Transformational Wrap-Around Program shall be terminated immediately. The participant will be granted a sixty (60) day period to vacate the unit. It is the responsibility of the participant to inform LNHA promptly of any changes in custody arrangements.
B. Orders of Protection and Relocation
In situations where relocation becomes necessary due to Orders of Protection, resulting in changes to household size, LNHA reserves the right to enforce a transfer of the participant to a different rental unit or to adjust the terms of residency. This measure ensures that housing allotments remain in alignment with program policies and household needs.
1) Documentation Requirements
Participants must provide necessary legal documentation that verifies changes in custody or protection orders to LNHA within a specified timeframe. Failure to provide timely and accurate documentation may result in immediate termination of rental rights and initiation of the vacate process.
2) Support Services
LNHA may offer support services to assist participants during transitions related to custody changes or relocations. Participants are encouraged to contact LNHA for guidance and support through these processes.
12. MANDATORY TERMINATION
Violation of any of the following requirements shall result in termination of all household members:
A. Principal Residence Requirement
The head of household must occupy his or her unit as his or her principal place of residence, defined as occupancy for at least 273 days of a 365-day period.
B. Abandonment
Transformation Wrap-Around Program units must not be unoccupied for more than seven (7) consecutive days without prior written approval from LNHA. If a unit is unoccupied for more than seven (7) consecutive days without prior written approval, shall be deemed abandoned and all participants shall have their participation in the Transformational Wrap-Around Program immediately terminated.
C. Methamphetamine
If LNHA has reasonable suspicion of Methamphetamine storage, use, or manufacture in any unit, this will be deemed a violation, resulting in the immediate termination of tenancy for all household residents, regardless of their knowledge of such activities. Termination proceedings are outlined in Chapter 3, Section 8 Mandatory Termination, Subsection (C), Page 54. Any grievances related to this termination may be directed solely to the Executive Director, whose decision shall be final.
13. MAINTENANCE
Participants in the Transformational Wrap-Around Program are responsible for the basic upkeep of their home. LNHA will provide a detailed document outlining the required cleaning and maintenance standards, which will be given to all participants at the time of occupancy.
A. Participant Responsibilities
Participants must adhere to the cleaning and maintenance standards specified in the provided document to ensure the home is maintained in good condition.
B. LNHA Responsibilities
General maintenance, such as repairs and upkeep of the structure and major appliances, is the responsibility of LNHA.
C. Requesting Repairs
Participants should request repairs that fall under LNHA’s responsibility in accordance with the procedures outlined in the Maintenance Chapter of these Policies and Procedures. For specific instructions and guidelines, refer to Chapter 11 – Maintenance, Page 145.
14. PROGRAM SECURITY DEPOSIT
All participants in the Transformational Wrap-Around Housing Program are required to pay a security deposit of $500 prior to occupancy. LNHA will conduct a move-out inspection within fourteen (14) days of a participant’s relinquishment of a unit to determine if there is any damage for which the participant is responsible.
A. Retention of Security Deposit
If there is damage to the unit for which the participant is responsible, LNHA shall retain the necessary amount from the participant’s security deposit to cover the estimated cost of repairs. LNHA may also retain funds from the security deposit to cover any other debts owed by the participant to LNHA. LNHA shall make reasonable attempts to notify the participant of the reasons for withholding monies from the security deposit.
B. Return of Unused Security Deposit
Any portion of the security deposit not retained to cover the estimated costs of repairs or other debts to LNHA shall be returned to the participant within thirty (30) days of the final move-out inspection.
C. Actual Costs Less than Original Estimate
If the actual costs of repairs are less than the original estimate, LNHA shall return the unused portion of the retained security deposit to the participant within ten (10) days of the completion of the repairs.
D. Actual Costs Exceeding the Original Estimate
If the actual costs of repairs exceed the original estimate, the participant shall be required to reimburse LNHA for the additional costs exceeding the withheld amount.
15. DURATION
The duration of participation in the Transformational Wrap-Around Housing Program will be determined by the Transformational Wrap-Around Team. LNHA will collaborate with the participant or family to ensure a smooth transition into an appropriate LNHA program or the larger community, if applicable, before termination from the Transformational Wrap-Around Program.
16. CERTIFICATION
Participants in the Transformational Wrap-Around Housing Program shall be subject to the Certification Procedures detailed in Chapter 3, Section 11, Page 58.
17. HOME INSPECTIONS
The provisions of Chapter 3, Section 14, Page 61 apply to the Transformational Wrap-Around Program unless otherwise stated in this Chapter.
18. TERMS OF THE AGREEMENT
A. Standard Terms
1) Sole Occupancy
The applicant and their family must be the only residents of the unit.
2) Payment of Assistance
All assistance payments will be made directly to the LNHA Cash Receipts Office.
3) Housing Unit Entitlement
Participants are not entitled to a specific housing unit and will not receive a leasehold interest in any housing unit.
4) No Subletting or Leasing
Participants are prohibited from leasing or subletting their units, regardless of the terms of the program agreement.
